On the docket this week: Highland Lakes arson suspect, sexual assault, kidnapping pair back in court

The second week of October was full of delays in the 4th Judicial District, stalling a handful of cases, including the one for the January King Soopers homicide suspect and the teen accused of fatally shooting a 17-year-old.

More hearings are ahead for the third week of the month. Here is the rundown.

Monday:

Lacey Tillitt, the woman accused of sparking the Highland Lakes fire that burned more than 150 acres near Divide last year, is set to enter a plea Monday. During her latest court proceeding in August, Tillitt was deemed competent to proceed to trial after concerns over her competency led to a mental health stay early in the case.

Tillitt, 77, also referred to as Lowa Tillitt in public records, was arrested Jan. 16 for allegedly starting the fire on Oct. 28. The fire burned 166 acres northwest of Divide and caused the evacuations of more than 700 households. Tillitt faces one count of felony arson for endangering more than $1 million in property.

Tuesday:

Marquise Hutt, the suspect in a February 2024 homicide in Colorado Springs that took the life of 55-year-old Omar Olmedo, is set for a plea hearing Tuesday.

In the early hours of Feb. 29, 2024, police were dispatched to The Lamplighter Mobile Homes near South Academy Boulevard. When they arrived, they said they found Olmedo lying on his back with a small pool of blood near him. He succumbed to his injuries on March 5, 2024, after days on life support.

Hutt was arrested in early December following several months of investigation. He faces three felony charges, including first-degree murder, second-degree murder and one count of attempting to influence a public servant, according to court records.

Wednesday:

Also in court this week for plea hearings are Jerome Scott and Gerald Brooks, a pair of roommates accused of holding two runaways hostage and providing drugs and alcohol before sexually assaulting them.

Investigators arrested Scott, 63, and Brooks, 68, in early July after connecting them to the sexual assault and kidnapping of the two teenage girls, who were allegedly being held inside an apartment on the south edge of downtown Colorado Springs.

At the pair’s most recent hearings, prosecutors said any plea deals offered would be “harsh.” When the judge asked about the chances of a plea deal, the prosecution said they expected that Brooks and Scott would not take one.

Thursday:

Chase Mikesell, a deputy with the Teller County Sheriff’s Office and the son of Teller County Sheriff Jason Mikesell, is set to enter a plea after he was arrested nearly two months ago on suspicion of DUI.

The incident happened around 9 p.m. on Aug. 3, along U.S. 24 at the Divide junction, when Mikesell allegedly rear-ended a vehicle that was stopped in a construction zone. A breath test resulted in a 0.149 BAC, which is nearly double the legal Colorado limit of 0.08.

The Teller County deputy faces four misdemeanor charges, including possession of a weapon under the influence, driving while intoxicated and careless driving.

In court for the third consecutive week is 35-year-old Dustin Boston, who is facing charges related to a fatal shooting in a parking lot by the King Soopers near the corner of Stetson Hills and North Powers boulevards on Jan. 20.

The shooting left Tyray Ikener, 32, dead, with police investigators saying they believe car theft was the motive behind the alleged homicide.

It has been nearly nine months, and little progress has been made in the criminal case. Boston was set to enter a plea Thursday, but similar to the previous week, he allegedly refused transport to the courthouse, citing an illness.

For Thursday’s hearing, an El Paso County judge signed an order stating Boston must be transported to court “by any means necessary.”

Friday:

Shaquille Brown, 31, the man accused of killing one person outside the El Paso County courthouse in November 2023, is set for a competency to proceed hearing.

Brown was arrested outside the courthouse after he allegedly shot and killed 28-year-old William Winters. Brown told police that he shot and killed Winters because earlier that year, Winters allegedly assaulted Brown at a bar in downtown Colorado Springs, causing injuries that he said required surgery.

The alleged shooter faces multiple felonies, including first-degree murder, menacing, and illegal possession of a weapon by a previous offender. Brown’s case has been in limbo for months due to competency concerns, and Friday’s hearing is likely to determine whether the case can move forward or not.
