One of the several people facing kidnapping-related allegations pleaded guilty on Monday, receiving a 20-year sentence to the Department of Corrections.

Joseary Arizmendi was one of several individuals facing charges after the group allegedly kidnapped and assaulted a couple at a Colorado Springs apartment complex for reporting one of the defendants’ boyfriend, Shemor Mitchell, to the police.

Mitchell has been identified by The Gazette as a suspect in the alleged attempted murder of a 22-year-old man at the “PopCycle” Bridge on Jan. 22.

Arizmendi was one of three co-defendants scheduled to appear in court on Monday, but the only one who had their case reach a conclusion.

At the start of the hearing, Arizmendi’s attorney, Susan Chadderdon, informed the court that the two parties had agreed on a plea deal. The terms of the plea agreement read aloud in court saw Arizmendi plead guilty to one count of second-degree kidnapping with a stipulated sentence of 20 years to the Department of Corrections.

After the guilty plea, the court went directly to sentencing, where Chadderdon asked the court to accept the agreed upon sentence, but that she was “devastated” to ask to do so.

“I know (Arizmendi) is not a bad person, not a violent person,” Chadderdon said, going on to say that Arizmendi was least at fault for the kidnapping and was ultimately the person who released the couple from the apartment.

Judge Jessica Curtis, after accepting the plea agreement and sentencing Arizmendi, echoed the statements made by Chadderdon that Arizmendi isn’t a bad person, but said that she made “very bad decisions.”

Prior to accepting the plea agreement, Arizmendi was undergoing a competency evaluation. Current co-defendant Linda Guest is still undergoing a competency evaluation in her case.

Co-defendants Mellissa Martinez and Kathy Arbuckle were both scheduled to appear in court on Monday for arraignment hearings, but both were not transported to court due to illness, according to Judge Curtis.

Martinez and Arbuckle will return to court on Jan. 27 for their rescheduled arraignment hearing. Guest will make her next court appearance on Feb. 6 for a review hearing.

Guest, Arizmendi, Martinez, Arbuckle and Joshua Pleasant face 17 charges in connection to the incident, including first-degree kidnapping, witness and victim intimidation, first-degree assault, robbery and several violent crime sentence enhancements.

Martinez additionally faces a second open assault case in El Paso County, where she is charged with sexual assault and second-degree assault.

All five defendants remain in custody and have not posted a bond to be released, according to court records. Guest is now on a no-bond hold, according to court records.

Mitchell also remains in custody at the El Paso County jail on a total bond of just over $1.5 million between three cases. He will next appear in court on Jan. 13 for the preliminary hearing in his attempted homicide case.
