A Fort Carson soldier accused of killing his 2-year-old nephew will plead guilty to involuntary manslaughter at his court martial today, his attorney said Sunday.

Pfc. Jason A. Price, a soldier with the Fort Carson’s Warrior Transition Unit, was charged Jan. 24 with the second-degree murder of 2-year-old Kevin Rosa Perez, who investigators believe died Nov. 5, 2011, of blunt force trauma to the head.

“We feel that had we contested this case and been completely successful in establishing the facts as we know that they happened, we’d be in the world we are now with the plea deal,” said James Culp, Price’s civilian attorney, Sunday night.

“It’s about a terrible accident. There was no reason to put him at risk when the government was amenable to accepting the plea.

“He’s overwhelmed with guilt about what happened to Kevin. This is what he wants. He wants to take responsibility for what happened.”

Had Price been convicted of second-degree murder, he could have faced up to life in prison.

Price will now face a maximum sentence of 15 years.

A sentencing hearing should occur today, Culp said.
