Court documents reveal Fountain shootout started as botched robbery
A shootout in broad daylight in a residential area in Fountain that injured two had started as a botched robbery attempt, court documents reveal.
The Fountain Police Department responded to a call for shots fired in the 500 block of Blossom Field Road in the afternoon of April 25. Officers reported finding one adult male with an apparent gunshot, but receiving word that others had fled the scene.
A second man, David Downey II, 43, was later arrested after being taken to a nearby hospital with a gunshot wound. His arrest affidavit states Downey’s wife told police that he came home with a gunshot wound in his left arm and asked her to take him to an emergency room.
Investigators in the arrest affidavit say they believe a third man was lured to a home location where Downey intended to rob him. The arrest affidavit includes a description of nearby security camera footage found by investigators. It purportedly shows a man in a red van driving up to a house and parking at the end of the driveway. Seconds later, Downey approaches in his vehicle and blocks the red van’s exit path. An altercation between the homeowner and the man in the van ensues as Downey is seen exiting his vehicle with a sawed-off shotgun.
The altercation escalates when the man in the red van pulls his own gun out and fires at the homeowner, who investigators say may have been assisting Downey in the attempted robbery. The homeowner appears to have been wounded, even as more gunshots are seen coming from the van.
After fumbling with his shotgun for a few seconds, Downey fires back at the van, which reverses away from him and nearly hits the homeowner. As the two men continue shooting at each other, the red van tries to flee multiple times until it eventually manages to drive away.
Police recovered the shotgun used in the shooting, which had been stashed against the inside of the backyard fence of the residence. Droplets of blood were also seen on the sidewalk by the residence and on the driveway.
The red van was found abandoned later that day.
Fountain police declined to comment about potential charges for the other two individuals involved in the shooting, citing the department’s ongoing investigation.
Downey was initially booked into the El Paso County Jail on June 4 on suspicion of possession of a weapon by a previous offender, possessing a dangerous weapon and illegal discharge of a firearm, according to a news release from the Fountain Police Department.
The El Paso County jail confirmed he is no longer in custody. His next hearing is June 13.
