The Colorado Department of Regulatory Agencies has reprimanded the Evergreen Funeral Home in Colorado Springs for improperly storing bodies with an order for 12 months of probation, its order shows.

The agency’s investigation began after an anonymous tip was submitted on Jan. 20, leading regulatory officials to find more human remains than “capable of storing” while at a temperature above the mandated 39 degrees.

The stipulation and final order was signed by an agency program director and the designee of the Evergreen Funeral Home, Chris Gibson, by April 20, the date it was finalized.

The funeral home is located near the intersection of East Fountain Boulevard and South Union Boulevard next to the Evergreen Cemetery and the Shrine of Remembrance.

DORA also claims Evergreen Funeral Home failed to consistently file a chain of custody and had its designee listed at two locations.

In Colorado, funeral homes are required to complete a chain of custody when transferring human remains before releasing them to their final resting place.

Furthermore, funeral home designees must not represent more than one funeral home unless an additional location is under the same ownership and within 60 miles of the initial location.

For violating these regulations, Evergreen Funeral Home must complete a 12-month probationary period, including a requirement that the owner report any further violations within mandated daily internal compliance audit reports.

The funeral home must also submit a quarterly audit, including an affidavit from the owner, by the 10th day of July, October, January and April.

Evergreen Funeral Home was first registered to operate as a funeral home in 2010, according to the agency’s ruling. Records on DORA’s Division of Professions and Occupations indicate the funeral home has not had any other reported violations.
