Colorado Springs police arrested a fugitive after he walked away from an undisclosed community corrections facility in Pueblo, according to a blotter entry by the department.

Officers learned Richard Capek, 37, was in the area on Friday and had made threats to shoot law enforcement officers with an AR-15 rifle he was unlawfully possessing, police said.

Numerous CSPD units responded, including K-9 and air units, to the west lot of the Walmart at 8250 Razorback Road after Capek was located there in a vehicle.

Civilians were cleared from the area before police positioned their vehicles to block Capek from leaving and used a public address system to announce he was under arrest, the blotter states.

Capek tried unsuccessfully to escape while police warned chemical munitions would be deployed if he did not surrender. Pepper powder was then deployed into the car, causing Capek to exit, according to the blotter.

K-9 Riggs confronted Capek outside of the vehicle and followed all commands afterward. He was treated for exposure to the chemical before his custody was transferred to the Colorado Department of Corrections, the blotter states.

Police later recovered ammunition from the vehicle “designed to defeat bulletproof vests.” No officers or citizens were injured in the operation.

Capek previously pleaded guilty to theft of $20,000 to $100,000 and third-degree assault in separate incidents from 2023, according to court records.

CSPD did not issue an advanced notice of Capek’s possible activity in the area. However, Cañon City police issued a warning to its residents on Tuesday to be on the lookout.
