A Fremont County jail deputy was arrested this month after allegedly choking an inmate, authorities announced Thursday.

Luis Mora-Huerta, 62, was arrested Dec. 1 after investigators from the Colorado Bureau of Investigation learned of an interaction between Mora-Huerta and a 57-year-old inmate at the jail in Cañon City on Oct. 14.

During the interaction, Mora-Huerta is accused of placing his right hand on the front of the inmate’s neck in a “c-clamp” position while the inmate was pressed against the wall, according to investigators.

When the inmate stated, “He’s choking me,” the deputy allegedly said, “Yes, I am.” Colorado law prohibits peace officers from using a chokehold on a person.

The Fremont County Sheriff’s Office fired Mora-Huerta on Thursday following an internal affairs investigation, according to the bureau.

The Gazette has reached out to the Fremont County jail for comment. The Sheriff’s Office referred a reporter to the jail for comment.

Court officials said there is enough evidence to establish probable cause against Mora-Huerta, though the Bureau noted he is innocent until proven guilty in court.

The now former deputy is facing the following charges: first-degree official misconduct, official oppression and harassment.

Mora-Huerta posted a $1,000 bond and is out of jail, according to the Bureau. He is scheduled to appear in court for an advisement hearing on Tuesday, Dec. 16.
