The use of deadly force by two Colorado Springs police officers was found justified by the 4th Judicial District Attorney’s Office on Thursday, according to a news release from the office.

The findings come after Officers Brock Lofgren and Benjamin Johnson shot and killed Derrick Wardle after responding to an argument involving a firearm between him and a family member on Feb. 15.

Wardle’s mother reported to police that he had been exhibiting signs of paranoia and made comments about shooting police officers, according to the release.

Two family members, including Wardle’s mother, exited the residence while Wardle’s father remained. The release stated police instructed Wardle to exit the residence, but he told officers to enter.

As Lofgren approached, he saw Wardle holding a rifle with his father also in the room. Wardle did not comply with commands to drop the weapon, show his hands and exit the residence, according to the release.

Lofgren continued commands, inching closer — almost within arms reach of the gun — as Johnson entered the residence when Wardle “quickly raised” the weapon at officers, according to the release.

Both officers discharged their weapons, and Wardle was pronounced deceased at the scene after life-saving efforts.

The El Paso County Coroner found that Wardle died due to multiple gunshot wounds.

The district attorney’s office found officers were in immediate danger during a possible hostage situation that did not warrant them facing charges.
