The suspect in a fatal shooting earlier this year in the parking lot of a King Soopers is set for a second preliminary hearing after two new charges were added to his case in recent weeks.

Dustin Boston, 35, is facing several felony charges following his arrest on Feb. 13, including first-degree murder, for the death of Tyray Ikener, 32. According to police, Ikener was found dead with gunshot wounds inside a vehicle near the gas pumps adjacent to the King Soopers near the corner of Stetson Hills and North Powers boulevards on Jan. 20.

Boston has refused transport from the jail for the last several hearings, prompting Judge Catherine Mitchell Helton to issue a “by any means necessary” order to get Boston to court Thursday.

Initially set to enter a plea, Boston’s defense counsel requested a new preliminary hearing to determine if the two added counts could proceed alongside his other five charges.

According to past Gazette coverage, Helton ruled to dismiss a “special offender” charge while binding over the remaining five charges during Boston’s first preliminary hearing in April. Those charges include one count each of first-degree murder, first-degree murder with “extreme indifference,” second-degree murder, felony menacing and possession of a controlled substance.

The two additional counts granted by Helton on Oct. 13 are possession of a controlled substance and possession of a firearm by a previous offender, court records show.

Boston entered not-guilty pleas for the original five counts on Thursday. Following the new preliminary hearing on Nov. 20, he will enter pleas for the remaining two counts if probable cause is found for those charges to proceed.

Boston appeared in custody from the El Paso County jail, where he has remained on a no-bond hold for a parole violation since his arrest, inmate records show.

Boston’s trial is set to commence on Jan. 20, as long as no plea agreements are reached in advance of that date.
