Man who allegedly menaced Panorama middle schooler wanted to stop bullying

The man accused of flashing a gun and menacing students at Panorama Middle School last month in an attempt to stop bullying was convicted of a similar crime earlier this year, court records obtained by The Gazette reveal.

The suspect, Kyle Harvey, 26, is facing several felonies related to the Sept. 18 incident at the school, including a menacing charge, possession of weapons by previous offenders, unlawfully carrying a weapon and unlawful possession of weapons on school property, court records show.

According to the arresting documents for Harvey, two middle school students were standing on school property around 3:50 p.m. after school hours on Sept. 18 when allegedly a man wearing a black hood asked one of them where another student was.

The man, identified in court documents as Harvey, was wearing a fanny pack that he kept his hands in and was observed holding a gun in it, according to court documents obtained by The Gazette.

One of the children told police Harvey pulled the silver slide of the gun back with his right hand and was holding it in his left. While doing so, he allegedly said he was “sick” of the bullying of another student and was going to tell the bully to leave the student alone, along with an explative.

The Colorado Springs Police Department could not confirm with The Gazette whether Harvey has any relationship with the child.

Court documents stated Harvey then walked toward the school after a school security guard or teachers approached, according to differing testimonies from the children in court documents.

The child did not report the incident because he “froze” out of fear but did tell someone, whose name was redacted in court documents, later that evening. He cried during the night and the next day in class because he thought Harvey would shoot him.

A school resource officer was notified by a school administrator about the incident on Sept. 22 and statements from the children were collected, according to court documents.

Officers contacted Harvey on Sept. 25 before conducting a search warrant and he made a “spontaneous utterance” before allegedly telling police that a man broke into his house the previous night and left a bag full of guns.

Harvey allegedly told officers he took apart the guns, put them back together, set the bag in the backyard and placed the guns in his bedroom, according to court documents.

During the search, police found a 9mm beretta handgun, a silver Canik SFX 9mm handgun, a Sig Sauer rifle with a scope and multiple 9mm magazines and ammunition in his bedroom. Court documents stated all of the guns were loaded and each handgun had a holster.

District 2 Superintendent Wendy Birhanzel stated she learned of what happened through media reports and that all safety protocols were followed in reporting the incident, according to a news release on Sept. 25.

The district did not send any communication until after the suspect could be arrested following the execution of a search warrant, at the request of CSPD.

This is not the first time Harvey has faced a menacing charge this year. Harvey was convicted of menacing a woman with a gun in an apparent road rage incident in May, according to court documents.

Harvey tailgated the woman and waived at her to pull over after he passed her. Once parked, Harvey exited his car and “began cursing and threatening to shoot her” while holding a gun in front of him, court documents state.

Following his arrest, Harvey allegedly told police the gun belonged to a female passenger in his car and said he never pointed it at or threatened the woman. Court documents show a GX4 9mm handgun was recovered from the passenger.

Harvey also pleaded guilty to a violation of a protection order during an incident in July, court documents stated. After suspecting a woman was cheating on him, Harvey allegedly took her gun while she was in the shower and later threatened to kill her if he verified the cheating.

That gun was not one of the other four police have recovered from other incidents involving Harvey this year, according to court documents.

In three separate cases, Harvey will be sentenced on Nov. 17 for violation of a protective order, menacing and theft.

Harvey’s first court appearance regarding the Panorama Middle School case is scheduled for Thursday. As of Friday, he remains in El Paso County jail on a $25,000 bond amount, according to inmate records.
