A man has been arrested on suspicion of attempted second-degree murder, first-degree assault and menacing after allegedly shooting a gun during an argument Thursday afternoon.

The El Paso County Sheriff’s Office reports receiving a call around 2:20 p.m. Thursday about multiple gunshots heard in the vicinity of the 200 block of Cunningham Drive. Deputies responded to the scene and sent out a shelter-in-place alert for the surrounding area, including nearby schools.

When deputies arrived they found two adult males, both with non-life-threatening injuries. Both were transported to a nearby hospital for treatment.

One of those men, 77-year-old Gary Spicer, was booked into the El Paso County jail after being released from the hospital with minor injuries. The second man, who investigators say was the victim of the attempted murder, was treated and released from the hospital the same day.

Detectives say a domestic disturbance the previous night led to Spicer getting into a verbal altercation with his son-in-law. The son-in-law’s roommate intervened, and the son-in-law left the area. An altercation between Spicer and the roommate ensued, during which Spicer is believed by law enforcement to have fired a gun. He was subsequently disarmed and subdued until law enforcement arrived.

Jail records show Spicer remained in custody as of Friday afternoon, on a $25,000 bond. His first appearance in court is scheduled for Nov. 7.
