Arrest affidavit reveals new details about Colorado Springs home invasion

An arrest affidavit obtained by The Gazette for the suspect in the Saturday home invasion, 33-year-old Xavier Smith, has revealed that seven children and one teen were among the residents in the home that Smith is charged with menacing.

Just before 7 p.m., Colorado Springs officers with the Sand Creek Division responded to the 1200 block of Flycatcher Lane for a reported home invasion.

Upon officer arrival, it was determined that the suspect, allegedly Smith, had left the scene but one of the victims provided officers with a photograph of the truck he fled in.

None of the victims in the affidavit were referred to by name, but the document lists them by age, with the youngest being 2. Six other children are listed, with the oldest being 9. In addition, a 14-year-old and two adult women were listed.

One of the victims told law enforcement that she was in the basement when she heard screams and eventually spotted Smith walking down the stairs with a crowbar in hand.

According to the affidavit, Smith’s identity was confirmed through photographs in a law enforcement database.

Further investigation after the incident showed pry marks around the wooden frame of the front entrance. One of the victims told law enforcement he saw Smith’s silhouette in the window before it was pried open. Once inside the home, the affidavit claims that Smith allegedly yelled at the victim who saw him first, demanding money while pointing a gun.

After Smith continued downstairs where an additional seven victims were, he demanded money once again while still holding a gun. The victims fled the house shortly after, and Smith locked the door behind them, leaving him inside alone.

The affidavit alleges Smith was in the residence for five minutes before exiting out the back door to a truck and fleeing the scene.

Investigators say camera footage obtained after the incident shows Smith attempting to ring the doorbell on the front entrance and looking around. A later clip shows the victims running out of the house prior to Smith allegedly locking them out.

One of the victims of the home invasion told law enforcement she thinks Smith might have targeted the house due to a post on Snapchat two weeks prior regarding her receiving a large cash settlement from a traffic crash.

While Smith was able to flee, he was located a short time after by officers, where a search of his car uncovered various items including cocaine, $320 in cash, a light blue ski mask, black gloves and a black tire iron separated into two pieces.

Smith was charged with the following:

First-degree burglary, class three felony

Aggravated robbery, attempted, class four felony

Nine counts of menacing, class five felony

Eight counts of child abuse, class two misdemeanor

Unlawful distribution, manufacturing, dispensing or sale, class three drug felony

Smith is set to appear in court for his first appearance on the charges on Aug. 28.
