One of the four teenagers accused of killing 32-year-old Gabriel Villanueba last year pleaded not guilty to all charges on Tuesday, setting up for a trial early next year.

Santiago Dominguez, 18, appeared in court out of custody on Tuesday for a plea hearing.

At Dominguez’s previous hearing his attorney, Josh Tolini, informed the court that he was seeking a new plea hearing date to allow for additional time to negotiate with the prosecution. On Tuesday, Tolini informed Judge Marcus Henson that no plea agreement was reached, and Dominguez would be entering not guilty pleas to all charges, leading to a trial.

Dominguez faces 11 charges including second-degree murder, aggravated robbery, motor vehicle theft and several violent crime sentencing enhancements for allegedly shooting and killing Villanueba on Aug. 21.

According to previous reporting from The Gazette, prosecutors believe that Dominguez, Ali Talib, 18, and two juveniles aged 15 and 13 broke into Villanueba’s apartment off 19th Street in an attempt to steal his gun after Vilanueba and Dominguez got into an altercation at a party the previous evening.

After Dominguez entered not guilty pleas the prosecution informed the court that although negotiations were had with the defense, no plea offer was ever made. The prosecution added that there will be no further negotiations.

Dominguez, who appeared to court out of custody on Tuesday after posting a $75,000 surety bond, will have his trial begin on Jan. 27, 2025.

Talib, who is also out of custody after posting bond, will return to court next month on Sept. 10 for a review hearing.

At Talib’s previous hearing his attorney, Shimon Kohn, stated that he was requesting a two-month delay due to growing concerns over his client’s mental state. Kohn stated that conversations with his client over the weeks and months leading up to the hearing raised concerns and that the delay would be used to see if a potential impaired mental aptitude defense could be possible at a trial.

An update on the future of Talib’s case will come at the Sept. 10 review hearing.

Dominguez also faces an additional open criminal case where he is charged with aggravated robbery and menacing for an incident dated Aug. 29, according to court records.

The court set for Dominguez to appear for a preliminary hearing on the robbery charges in September; he has yet to enter a plea in the case.

The status of the cases against the 15- and 13-year-old juveniles is unknown at the time of writing.
