The motorcyclist who allegedly shot at another driver near Interstate 25 last week after a brief back-and-forth between the two while on the road, according to the arrest affidavit obtained by The Gazette. 

On June 13, Nelson Boyer, 40, allegedly shot at Danny Olsen, 61, while they were northbound on South Academy Boulevard past the I-25 bridge. Olsen was struck twice, once in the shoulder and once in the arm near his elbow. 

The affidavit revealed Olsen did not know Boyer. Olsen reported the suspect swung out in front of him twice after dropping off a woman at a nearby bus stop. 

The second time it happened, Olsen said he rolled down his window and said, “What’s up?” to which Boyer responded by pulling up in front of Olsen at the next stop light and refusing to move.  

Olsen yelled at Boyer to go and eventually pulled around him. As he passed, Boyer reached out and hit the sideview mirror of Olsen’s black SUV, which Olsen responded by calling him a “jerk.”

After that, Olsen heard four to five shots and felt his arm and back get hit as Boyer drove off. 

Reports indicate Boyer was driving a red and black Livewire electric motorcycle.

Four construction workers who witnessed the shooting reported seeing Boyer pulling out his firearm and firing after Olsen passed him. 

The shots also struck a woman’s vehicle and were fired in the direction of the median where the construction workers were working. 

A few minutes later, Olsen called the police from Dairy Lane in Security-Widefield, where he was transported to Memorial Hospital for treatment . No bullets were retrieved.

After the shooting, other workers took photos of Boyer searching the ground where the shooting occurred and driving off into Chadwick Drive, the street where Boyer lives with his family.

Boyer had been in a previous physical altercation with his brother at their residence a couple weeks before the shooting.

On June 3, a call to police from 1511 Chadwick Drive was made by Boyer’s father, who stated Boyer and his brother were in a physical fight with one another.  

A week before the shooting, a K-9 officer for the El Paso County Sheriff’s Office reported talking to Boyer, saying Boyer had a Glock handgun with an extended magazine that was loaded with hollow point ammunition at the time and was driving the motorcycle, which was temporarily registered to his home address. 

Boyer also told the officer that he was a formerly in the Marines. The Facebook page of a Nelson Boyer shows pictures of a motorcycle matching the description in the shooting and a video titled “Just new Gun Juggling,” showing a Marine Corps flag on the wall of a room in the background, and an arm spinning a black handgun.

Boyer is charged with attempted murder, first-degree assault, illegal discharge of a firearm and reckless endangerment. He is in jail with a bond of $250,000, and his next court date is June 26.
