The man accused of causing the death of Fountain police officer Julian Becerra last year was found guilty of murder and several other charges on Monday.

“Officer Becerra gave his life in service to our community as he and many others worked to stop three criminals who engaged in a violent crime spree,” said District Attorney Michael Allen in a press conference after the conviction.

Devon Bobian, 32, was the final person awaiting the end of their case among three individuals arrested for their alleged involvement in Becerra’s death.

Bobian, Anthony Vallejos and Daniesha Pacheco were arrested in February 2023 after stealing a car and leading multiple law enforcement agencies on a chase throughout El Paso County leading to Becerra’s death, according to previous Gazette reporting.

Evidence presented earlier in the trial by the prosecution showed that Bobian attempted to flee law enforcement on foot after the car pursuit, and that the attempt to flee from Bobian led to Becerra falling off a bridge to his death.

The verdict came back on Monday afternoon and the 12-person jury determined that Bobian was guilty of second-degree murder, aggravated robbery, felony menacing, vehicular eluding and motor vehicle theft.

Bobian’s sentence has yet to be determined as Judge Chad Miller opted to move Bobian’s sentencing back to allow for time to hold a habitual criminal hearing.

If Bobian is determined to be a habitual offender due to his previous felony convictions, the range of his possible prison sentence could change dramatically. Allen said on Monday that the sentence range for the conviction was from 16 to 96 years, depending on the result of the habitual offender hearing.

Second degree-murder is a class two felony, carrying a normal sentence range from 16 to 48 years with five years of mandatory parole, according to Allen. Being determined a habitual offender is a sentence enhancer.

“We are holding this violent offender accountable to the highest extent of the law,” said Allen, asking for understanding from the law enforcement community during the legal process.

Court records show Bobian in March of last year pleaded guilty to weapon possession by a previous offender in two different criminal cases in Pueblo County, each charge landing him 18 months in the Department of Corrections. Bobian’s sentence in those cases remains active.

The two co-defendants have already been sentenced for their involvement in the case.

Last year, Vallejos was sentenced to 27 years in prison after pleading guilty to one count of aggravated robbery with a deadly weapon, a Class 3 felony, for his involvement.

Earlier this year, Pacheco was sentenced to eight years in the Department of Corrections after pleading guilty to an amended count of aggravated robbery with a violent crime sentence enhancer.

Bobian’s habitual criminal hearing was scheduled for July 3 by Miller. Bobian’s sentencing hearing will be scheduled after the results of the habitual criminal hearing.
