A 37-year-old man was taken into custody Monday after police said he discharged a firearm near a child’s birthday party in southeast Colorado Springs.

David J. Gavin was arrested on suspicion of prohibited use of a weapon and reckless endangerment, police said.

Officers responded to reports of an intoxicated and suicidal man firing rounds from a handgun at a residence on the 4500 block of Hollyridge Drive, off Hancock Expressway, about 8 p.m., police said.

Police set up a perimeter surrounding the house and entered after getting word that the man inside, identified as Gavin, had passed out.

Gavin was taken into custody without incident, police said.

Gavin had allegedly become upset earlier in the day, had gotten a handgun from his home and fired several rounds from his front yard close to a birthday party that was going on nearby, police said.

Gavin will be advised of his charges Tuesday at the El Paso County courthouse, records show.
