Each of the four survivors of an early Wednesday shootout at an apartment complex in southeast Colorado Springs gave police a different story about the events that led to the death of a 19-year-old man.

But three of them agreed it was a drug deal gone bad, according to court documents.

Police said Friday the 4th Judicial District Attorney’s Office reviewed the case and determined that charges won’t be filed in connection with the death of Jacob Ramirez. Though no explanation was provided, court documents describe the shooting as self-defense. The coroner’s office ruled Ramirez’s death a homicide.

The shooting left two others wounded.

Joshua Davis, 18, was shot in the arm during the gun battle at the Cedar Creek Club Apartments on South Chelton Road. Davis told police that he, Ramirez and Arianna Dominguez-Huitron, also 18, had hatched a plan to rob “some people” that wanted to buy drugs from them, court documents state.

Those people were Steven Belgrave, 21, and his 18-year-old girlfriend, Jessica Mascarenas, documents state.

But Belgrave, who was shot in the chest, and Mascarenas, gave police differing accounts of what happened.

Belgrave said he and Mascarenas went to the Cedar Creek apartment complex to check on Dominguez-Huitron, who was having problems with her boyfriend. Belgrave said Mascarenas and Dominguez-Huitron are friends.

When they walked into the apartment building, Mascarenas and Dominguez-Huitron started fighting, Belgrave said. When he tried to break up the fight, he saw two armed men approaching.

Belgrave told police he carries a .40-caliber handgun in a holster on his hip. Fearing for his life, he drew the gun and started to point it at one of the men, who tackled him in the stairwell. After a struggle, Belgrave was shot in the chest. When he managed to get free, Belgrave said he shot the man who shot him, hitting him in the upper chest or neck area, and then he shot the other armed man, who was standing nearby, documents state. Davis died from a gunshot wound to the neck.

When police first interviewed Belgrave, he said he had been shot by a robber at a 7-Eleven when he refused to give up his wallet.

But during the interview, Belgrave “eventually admitted that the story about the robbery was not actually what happened,” documents state.

Dominguez-Huitron told police she had arranged to get Mascarenas “mushrooms” and that she planned to have the drugs delivered after Mascarenas gave her the money, documents state. She also told police she didn’t witness the shooting because she was fighting with Mascarenas.

Dominguez-Huitron and Davis face charges of aggravated robbery, a third-degree felony.

Mascarenas told police she heard gunshots but also didn’t see the shooting.
